英國租客改革法案引爭議 如何影響英國業主

對於英國大量物業投資者而言,私人租務市場的表現是重要考慮因素,很多投資者選擇將物業出租予租客,長遠獲取最大回報。

買樓出租市場有大量法例及法規需要留意,業主和投資者需要了解多個擬定及即將生效的變動。租客改革法案是2019年以來一直在醞釀的重大法律改革。

這是一項激進計劃,制訂了物業市場的一些重大改革,以及租客的新權利。儘管許多擬議的調整被視為對市場有利,但就提高標準而言,其他調整則較不受歡迎,被認為是針對業主,而此時他們對於提供數以百萬人的住宿擔負歷史重任。

《租客改革法案》有何內容?

數週前,英國國會議員Simon Clarke證實,《租客改革法案》將在本屆國會進行討論。

然而,最終立法內容仍未確定,據報已下台的首相卓慧思(Liz Truss)提議的其中一項最大改動(即廢除第21條驅逐權)將不包括在議案內。

  • 第21條(無過錯)驅逐權:現時業主可在固定租期結束或自動定期續約期間驅逐租客,而無需給予理由。該議案遭到一些業主組織及市場從業員批評,因為可能導致業主更難驅逐租客。有關構思是將會推出一套經修訂的業權理據,可在拖欠租金或期望出售物業或搬回物業等情況下保障業主。
  • 定期租賃:這可取代保證短期租約,這是目前最常見的租賃形式。英國政府的白皮書指出,這將表示「雙方將更能理解各自的權利及責任」,以及「為租客提供更大安全保障,同時保留私人租住物業重要的靈活性」。白皮書補充指:「租客將能離開質素惡劣的物業,無需繼續支付租金,或當他們情況發生變化,則較容易搬遷,例如找到新工作機會。」
  • 租金檢討條款:根據《租客改革法案》,這些條款將被廢除,這表示業主每年只能加租一次。他們還必須提前兩個月通知加租。在租約期間,實際上大多數業主不會更頻繁加租,此舉是為保障租客免受「無良業主」欺壓。
  • 接受寵物及領取援助人士:根據《租客改革法案》,業主將不能再就旗下物業採用「一攬子禁令」自動拒絕某類租客。這對申領援助或飼養寵物的租客更為公平,減少市場的歧視情況。

當前政治形勢雖然不確定,何時在國會討論《租客改革法案》,以至該法案哪些部分可能作出調整,甚至剔除,均屬未知,但業主必須留意市場的潛在變化。

當局期望提高整個私人租務市場的標準及公平性,使其對租客更吸引,同時有利守法負責的業主及物業投資者蓬勃發展。
