{"id":5023660,"date":"2019-05-24T12:10:52","date_gmt":"2019-05-24T11:10:52","guid":{"rendered":"https:\/\/www.buyassociation.co.uk\/?p=5023660"},"modified":"2019-05-24T12:10:52","modified_gmt":"2019-05-24T11:10:52","slug":"will-a-new-prime-minister-spark-a-change-in-policy-for-buy-to-let-landlords","status":"publish","type":"post","link":"https:\/\/www.buyassociationgroup.com\/en-us\/news\/will-a-new-prime-minister-spark-a-change-in-policy-for-buy-to-let-landlords\/","title":{"rendered":"Will a\u00a0new\u00a0Prime Minister spark a change in policy for\u00a0buy-to-let landlords?\u00a0"},"content":{"rendered":"<p><strong>Andrew Turner, chief executive at specialist buy to let mortgage broker\u00a0<a href=\"https:\/\/www.commercialtrust.co.uk\/\" target=\"_blank\" rel=\"noopener\">Commercial Trust Limited<\/a>, sets the scene for how a change in leader could benefit landlords.\u00a0<\/strong><\/p>\n<p><span data-contrast=\"none\">The past four years have brought radical change to the buy to let industry, at a time when demand for private rented housing is at an all-time high, benefits have caused rental arrears and there is the pressing issue of homelessness.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Government policies\u00a0<\/span><span data-contrast=\"none\">since 2016\u00a0<\/span><span data-contrast=\"none\">have resulted in a\u00a0<\/span><span data-contrast=\"none\">recent\u00a0<\/span><span data-contrast=\"none\">slow-down in buy to let mortgage applications, highlighted recently by UK Finance.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">At the same time, changes have resulted in the threat of many established landlords leaving the sector.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<h4>Significant changes to the sector<\/h4>\n<p><span data-contrast=\"none\">The introduction of the 3% stamp duty surcharge in April 2016, has put\u00a0<\/span><span data-contrast=\"none\">some investors off buy to let. In\u00a0<\/span><span data-contrast=\"none\">London, where house prices\u00a0<\/span><span data-contrast=\"none\">and thus stamp duty\u00a0<\/span><span data-contrast=\"none\">are significantly higher,\u00a0<\/span><span data-contrast=\"none\">there has been<\/span><span data-contrast=\"none\">\u00a0stagnation in some areas.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Changes to the wear and tear tax relief and of course the reduction and phasing out of mortgage interest tax relief, continue to hit landlords in the pocket.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">At the same time, the Government has introduced new licensing rules affecting Houses of Multiple Occupation and Minimum Energy Efficiency Standards \u2013 both of which have caused thousands of\u00a0<\/span><span data-contrast=\"none\">landlords<\/span><span data-contrast=\"none\">\u00a0further expenditure.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Earlier this year, the Government indicated that it wants to abolish Section 21 eviction notices \u2013 potentially limiting a landlord\u2019s ability to regain possession of the property they own, should the worst scenario manifest with a tenant. This issue is a particularly sensitive one with landlords.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<h4>Change for the right reasons?<\/h4>\n<p><span data-contrast=\"none\">Whilst the Government has stated that its intentions are to raise standards in the private rental sector, to improve living conditions for a growing renter base, each law change has indirect consequences.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Some cynics have suggested that the policy changes have been nothing more than an attempt to win votes from the tenant population.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Whatever the intent, landlords, agents and tenants are having to deal with the consequences of these changes.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">If landlords leave the sector, there is potentially less private rental housing stock available for the growing tenant demand \u2013 and market forces will then likely see a rise in rents, which affects the people the Government says it most wants to help.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">A recent survey from the National Landlords Association indicated that\u00a0<\/span><span data-contrast=\"none\">85<\/span><span data-contrast=\"none\">% <\/span><span data-contrast=\"none\">of landlords would be likely to vote against any\u00a0<\/span><span data-contrast=\"none\">political\u00a0<\/span><span data-contrast=\"none\">party proposing to remove Section 21; and 89<\/span><span data-contrast=\"none\">%<\/span><span data-contrast=\"none\">\u00a0would\u00a0<\/span><span data-contrast=\"none\">be\u00a0<\/span><span data-contrast=\"none\">against any party proposing rent control<\/span><span data-contrast=\"none\">s<\/span><span data-contrast=\"none\">.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The poll also reflected landlord sentiment over how they feel the Government has perceived their industry, with just<\/span><span data-contrast=\"none\">\u00a0one in six private landlords s<\/span><span data-contrast=\"none\">uggesting\u00a0<\/span><span data-contrast=\"none\">they would support the Conservatives in an election.<\/span><span data-contrast=\"none\">\u00a0Two thirds of those landlords said they voted Conservative at the last election.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<blockquote><p><span data-contrast=\"none\">Richard Lamb<\/span><span data-contrast=\"none\">ert, chief executive of the NLA, recently commented.\u00a0<\/span><span data-contrast=\"none\">\u201cIt\u2019s hardly surprising that landlords are losing faith in the Conservatives given the way their government has overturned the economic, and now legislative, foundations of the private rented sector since 2015. The Tories\u2019 attitude seems to be \u2018Well, who else are landlords going to vote for?\u2019\u202fThe response is coming<\/span><span data-contrast=\"none\">\u00a0back loud and clear, Not you.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p><\/blockquote>\n<p><span data-contrast=\"none\">\u201c<\/span><span data-contrast=\"none\">Conservative ministers need to take the time to understand what\u2019s actually happening in the private rented sector or it may end up costing them dearly.\u201d<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<h4>What opportunity is there for change?<\/h4>\n<p><span data-contrast=\"none\">Of course rumours about the Prime Minister\u2019s future abound and one can only speculate at who might replace Mrs May, not to mention their views of the private rental sector.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">However, there is a universal acceptance that housing needs to be a top priority.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Several members of the Conservative Party have publicly called for changes to some of the legislation that has been introduced.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">In March, former\u00a0<\/span><span data-contrast=\"none\">work and pensions secretary Iain Duncan Smith, suggested to a conference in London, that landlords who let to social tenants should pay less tax.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">He also criticised some of the landlord tax changes made by the Government, suggesting:\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<blockquote><p><span data-contrast=\"none\">\u201cI think there have been some mistakes made. I think we really do need to ensure that we keep the social rented sector functioning, and with reasonable margins so that [landlords] stay in it, otherwise we\u2019re going to be pushed to find rental properties for people and some of that pressure already exists.\u201d<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p><\/blockquote>\n<p><span data-contrast=\"none\">In August 2017, prominent Tory\u00a0<\/span><span data-contrast=\"none\">Jacob<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">Rees-<\/span><span data-contrast=\"none\">Mogg<\/span><span data-contrast=\"none\">, insisted that s<\/span><span data-contrast=\"none\">tamp duty must be cut &#8220;as a matter of urgency&#8221;, warning that a failure to do so, could cost the party the next election.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Twelve months later, Boris Johnson, former Home Secretary and a rumoured Conservative Party leadership candidate, also called for the abolition of stamp duty, which he described as \u201cabsurdly high\u201d.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Johnson called housing \u201cthe single biggest and most urgent crisis we face\u201d.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<h4>What happens next?<\/h4>\n<p><span data-contrast=\"none\">Reform must come from within the Government.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The latest English Housing Survey revealed the nation\u2019s growing reliance on the private rental sector, which grew to 4.5 million households in 2017-18, constituting 19% of all households. The EHS data indicates that the PRS has more than doubled since 2002.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Not only is Government reliance on landlord voters at stake with policies, but the effect of changes impacts on the whole housing sector and where people can live.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Clearly it would seem from public statements made by prominent Conservatives, that housing policy \u2013 and in particular the changes imposed upon landlords, have not been universally agreed.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">So there is the possibility that we could end up with a Prime Minister with a different view on how landlords should be treated.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">For thousands of landlords and agents it is a game of wait and see.
