{"id":4023437,"date":"2019-03-27T13:15:11","date_gmt":"2019-03-27T13:15:11","guid":{"rendered":"https:\/\/www.buyassociation.co.uk\/?p=4023437"},"modified":"2019-03-27T13:15:11","modified_gmt":"2019-03-27T13:15:11","slug":"could-new-cgt-rules-offer-investment-opportunities-for-buy-to-let-landlords","status":"publish","type":"post","link":"https:\/\/www.buyassociationgroup.com\/en-us\/news\/could-new-cgt-rules-offer-investment-opportunities-for-buy-to-let-landlords\/","title":{"rendered":"Could new CGT rules offer investment opportunities for buy-to-let landlords?\u00a0"},"content":{"rendered":"<h3><span data-contrast=\"auto\">With house price growth slowing down and prices even falling in some areas, there is an argument that it is a buyer\u2019s market for buy to let investors.<\/span><span data-contrast=\"auto\">\u00a0Changes to Capital Gains Tax\u00a0<\/span><span data-contrast=\"auto\">(CGT)\u00a0<\/span><span data-contrast=\"auto\">could fuel property\u00a0<\/span><span data-contrast=\"auto\">changing hands\u00a0<\/span><span data-contrast=\"auto\">between landlords.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/h3>\n<p><span data-contrast=\"auto\">In the Autumn Budget of 2018, Chancellor Philip Hammond announced the abolition of lettings tax relief from April 2020.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The rules in particular, could impact on \u2018<a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/05\/14\/rising-number-accidental-landlords-now-begin-fall\/\">accidental landlord<\/a>s\u2019<\/span><span data-contrast=\"auto\">, those<\/span><span data-contrast=\"auto\">\u00a0who once lived in a property and then decided to rent it out.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The sale of a former residence which has latterly been let out, may be liable for <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2019\/03\/15\/whats-in-store-for-buy-to-let-landlords-in-the-next-tax-year\/\">Capital Gains Tax<\/a>, if the property is worth more at sale than when purchased. Until April 2020,\u00a0<\/span><span data-contrast=\"auto\">up to \u00a340,000 of letting relief may apply. This relief has the benefit of potentially reducing the amount CGT is charged on.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This relief is currently worth up to \u00a311,200 of CGT savings.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">After<\/span><span data-contrast=\"auto\">\u00a0April 2020,\u00a0<\/span><span data-contrast=\"auto\">this lettings relief is\u00a0<\/span><span data-contrast=\"auto\">being withdrawn<\/span><span data-contrast=\"auto\">, except to those who occupy the property with a tenant.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This is naturally a bitter pill to swallow<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">\u2013 and could prompt\u00a0<\/span><span data-contrast=\"auto\">those<\/span><span data-contrast=\"auto\">\u00a0<a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/category\/buy-to-let-landlords\/\">landlords<\/a>\u00a0<\/span><span data-contrast=\"auto\">affected, who had plans to sell in the next couple of years,\u00a0<\/span><span data-contrast=\"auto\">to\u00a0<\/span><span data-contrast=\"auto\">do so<\/span><span data-contrast=\"auto\">\u00a0before the April 2020 deadline.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Tax<\/span><span data-contrast=\"auto\">\u00a0is of course complicated<\/span><span data-contrast=\"auto\">. It is vital not to make a knee-jerk decision<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0prior to consulting with a tax professional, because the financial implications may or may not be significant<\/span><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In November 2018, Victoria Whitlock wrote on the Homes and Property website:<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<blockquote><p><span data-contrast=\"none\">\u201cLots of accidental landlords, especially those who\u2019ve seen their properties increase in value, will now be planning to kick out their tenants to move back into the properties themselves, or to sell them before April 2020.\u201d<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p><\/blockquote>\n<p><span data-contrast=\"auto\">Whether a lot decide to sell, or more likely a modest number,\u00a0<\/span><span data-contrast=\"auto\">affordability is still a huge challenge for some<\/span><span data-contrast=\"auto\">\u00a0prospective buyers<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">O<\/span><span data-contrast=\"auto\">ther landlords may benefit from the opportunity\u00a0<\/span><span data-contrast=\"auto\">to buy properties already set up<\/span><span data-contrast=\"auto\">\u00a0as rentals<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0from anyone looking to sell.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<h3><b><span data-contrast=\"auto\">Further CGT changes<\/span><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/h3>\n<p><span data-contrast=\"auto\">The rules around CGT will also put a greater urgency on landlord payment of such liabilities from April 2020.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">At present, landlords who sell a rental property and make a capital gain, have until January 31<\/span><span data-contrast=\"auto\">st<\/span><span data-contrast=\"auto\">\u00a0in the year after the tax year they made the sale, in which to pay their bill.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">So, for example, if an individual made a taxable capital gain from a property sale in May of 2018, they would not have to pay this tax liability until January 31<\/span><span data-contrast=\"auto\">st<\/span><span data-contrast=\"auto\">\u00a02020.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">From April 2020, a CGT bill on the sale of a residential property, by a landlord, will have to be settled within 30 days of the completion of the disposal.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;335559739&quot;:300}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The clock is ticking and at the time of writing, there are just over twelve months\u00a0<\/span><span data-contrast=\"none\">until<\/span><span data-contrast=\"none\">\u00a0the above changes in CGT.
