{"id":8428,"date":"2017-12-14T10:15:26","date_gmt":"2017-12-14T10:15:26","guid":{"rendered":"https:\/\/www.buyassociation.co.uk\/?p=8428"},"modified":"2017-12-14T10:15:26","modified_gmt":"2017-12-14T10:15:26","slug":"landlord-licensing-affect","status":"publish","type":"post","link":"https:\/\/www.buyassociationgroup.com\/en-gb\/news\/landlord-licensing-affect\/","title":{"rendered":"Landlord licensing: What is it and how could it affect you?"},"content":{"rendered":"<p><strong>Liverpool is the only city in the country to run a compulsory Landlord Licensing scheme, but other areas are subject to selective licensing, too.<\/strong><\/p>\n<p>Since 2006, local authorities have had the power to enforce a selective licensing scheme in their area, typically if there is a problem with low <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2017\/07\/26\/demand-uk-housing-rise\/\">housing demand<\/a> or where antisocial behaviour is an ongoing and serious issue &#8211; but thousands of law-abiding landlords are unaware that they exist, according to experts.<\/p>\n<p>There is no comprehensive, country-wide list of areas that are affected by the selective licensing, so landlords must <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/04\/18\/landlord-licensing-and-compliance-just-got-easier\/\">check with their individual council<\/a> to see if they are affected.<\/p>\n<h4>What are the rules?<\/h4>\n<p>Where an area is covered by the scheme, landlords must submit an application to obtain a licence, with fees payable of around \u00a3400 &#8211; depending on the area &#8211; and the local authority may request proof of <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/01\/26\/home-fire-risk-tackled-new-product-safety-office-grenfell\/\">safety certificates<\/a>, existing <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2017\/07\/27\/50-britains-landlords-increased-checks-since-grenfell-tower-fire\/\">smoke and carbon monoxide<\/a> detectors, and <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/01\/08\/new-three-year-tenancy-policy-supports-landlords-and-tenants\/\">tenancy agreements<\/a>.<\/p>\n<p>Some of the areas operating a selective licensing scheme include certain parts of Blackburn, Blackpool, Gateshead, Middlesbrough, Peterborough, Salford, Stoke-on-Trent and Wolverhampton, as well as parts of London including Croydon and Brent.<\/p>\n<p>Landlords who break the rules can face hefty fines. &#8220;The punishments can be very high,&#8221; said Richard Tacagni, founder and managing director of London Property Licensing. &#8220;Landlords can be forced to pay 12 months\u2019 rent back to a tenant, or could be told that they are unable to rent out a property in future.&#8221;<\/p>\n<p>There are exceptions, such as holiday lets, business premises, <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2017\/12\/05\/top-place-invest-student-housing-robust-returns\/\">student accommodation<\/a> owned by the university, and properties where the tenant is a relative of the owner.<\/p>\n<p>And <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2017\/11\/16\/make-sure-you-know-the-new-rules-about-hmos-for-2018\/\">houses of multiple occupancy<\/a> (HMOs) fall under their own bracket of licensing, although owners of small HMOs should still check with the council.<\/p>\n<h4>What about Liverpool?<\/h4>\n<p>In <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2017\/11\/14\/10-big-changes-liverpool-metro-mayor\/\">Liverpool<\/a>, all private landlords must apply for a licence for each property they rent out. The first level of application involves taking a &#8220;fit and proper person check&#8221; online &#8211; at a cost of \u00a350 &#8211; followed by a submission for each property requiring a licence &#8211; \u00a3400 for the first property, followed by \u00a3350 for each additional property.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-8460 size-medium\" src=\"https:\/\/www.buyassociationgroup.com\/en-gb\/wp-content\/uploads\/sites\/2\/2017\/12\/beatles-1827323_1280-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/www.buyassociationgroup.com\/en-gb\/wp-content\/uploads\/sites\/2\/2017\/12\/beatles-1827323_1280-300x225.jpg 300w, https:\/\/www.buyassociationgroup.com\/en-gb\/wp-content\/uploads\/sites\/2\/2017\/12\/beatles-1827323_1280-1024x768.jpg 1024w, https:\/\/www.buyassociationgroup.com\/en-gb\/wp-content\/uploads\/sites\/2\/2017\/12\/beatles-1827323_1280-768x576.jpg 768w, https:\/\/www.buyassociationgroup.com\/en-gb\/wp-content\/uploads\/sites\/2\/2017\/12\/beatles-1827323_1280.jpg 1280w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>The licences last until 31 March 2020, unless there has been evidence of poor property management in the past, in which case they might be issued for a shorter length of time. According to Liverpool City Council, the scheme will &#8220;weed out <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2017\/11\/22\/controversial-new-website-ruffling-feathers-landlords-letting-agents\/\">bad landlords<\/a>&#8220;.<\/p>\n<p>&#8220;If someone cannot meet the &#8216;fit and proper&#8217; landlord criteria the scheme sets out, they will be refused a licence,&#8221; it says on its website. &#8220;Bad landlords who do not invest in their properties\u00a0or manage them properly will move out of the market, making Liverpool an attractive prospect for good landlords.&#8221;<\/p>\n<p>Since the scheme was introduced in 2015, 38,000 licences have been granted, but 6,500 unlicensed properties across the city have been reported.<\/p>\n<p>Speaking after a recent court case which involved the prosecution of a landlord who&#8217;d failed to stick to the licensing rules,\u00a0Cllr Frank Hont, cabinet member for housing, said: &#8220;It is important that <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2017\/07\/17\/uk-private-rented-sector-doubled-since-1990s\/\">private rented<\/a> properties comply to minimum standards in relation to safety and property management.<\/p>\n<p>&#8220;There are many good landlords who have come on board with licensing and by pursuing those who don\u2019t, the council seeks to ensure a level playing field.
