For\u00a0<\/span><span data-contrast=\"none\">\u00a3200,000,\u00a0<\/span><span data-contrast=\"none\">the couple<\/span><span data-contrast=\"none\">\u00a0bought a derelict bungalow located in Weston-super-Mare as\u00a0<\/span><span data-contrast=\"none\">a\u00a0<\/span><span data-contrast=\"none\">buy-to-let investment<\/span><span data-contrast=\"none\">\u00a0and second property<\/span><span data-contrast=\"none\">.\u00a0<\/span><span data-contrast=\"none\">The\u00a0<\/span><span data-contrast=\"none\">bungalow<\/span><span data-contrast=\"none\">\u00a0was infested with asbestos and didn\u2019t have central hea<\/span><span data-contrast=\"none\">t<\/span><span data-contrast=\"none\">ing<\/span><span data-contrast=\"none\">,\u00a0<\/span><span data-contrast=\"none\">so\u00a0<\/span><span data-contrast=\"none\">th<\/span><span data-contrast=\"none\">ey\u00a0<\/span><span data-contrast=\"none\">completely demolished\u00a0<\/span><span data-contrast=\"none\">it\u00a0<\/span><span data-contrast=\"none\">and built a new home<\/span><span data-contrast=\"none\">.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;134233279&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Even though HM Revenue &amp; Customs argued buyers should have to pay the higher rate of stamp duty if the property could be used as a dwelling in the future, the tribunal said the charge should only apply if the home is immediately habitable.<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"none\">Exciting<\/span><\/b><b><span data-contrast=\"none\">\u00a0news for investors and developers<\/span><\/b><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;134233279&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">This ruling could allow previous buyers who paid the\u00a0<\/span><span data-contrast=\"none\">extra<\/span><span data-contrast=\"none\">\u00a0charge for a<\/span><span data-contrast=\"none\">n uninhabitable property\u00a0<\/span><span data-contrast=\"none\">to claim millions of pounds back.<\/span><span data-contrast=\"none\">\u00a0Additionally,\u00a0<\/span><span data-contrast=\"none\">the outcome of this case could encourage more\u00a0<\/span><a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/08\/20\/property-investors-who-stick-out-hard-times-still-make-good-returns\/\"><span data-contrast=\"none\">property\u00a0<\/span><span data-contrast=\"none\">investors<\/span><\/a><span data-contrast=\"none\">\u00a0and developers\u00a0<\/span><span data-contrast=\"none\">to\u00a0<\/span><span data-contrast=\"none\">buy derelict properties<\/span><span data-contrast=\"none\">\u00a0and renovate them<\/span><span data-contrast=\"none\">.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;134233279&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Recently, there has been a lot of\u00a0<\/span><span data-contrast=\"none\">tax changes<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">for<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">landlords<\/span><span data-contrast=\"none\">\u00a0and<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">buy-to-let investors<\/span><span data-contrast=\"none\">, which have made it more difficult for them to\u00a0<\/span><span data-contrast=\"none\">generate revenue<\/span><span data-contrast=\"none\">,<\/span><span data-contrast=\"none\">\u00a0so\u00a0<\/span><span data-contrast=\"none\">this recent ruling is\u00a0<\/span><span data-contrast=\"none\">likely\u00a0<\/span><span data-contrast=\"none\">welcome news.<\/span><span data-contrast=\"none\">\u00a0It brings forward a way investors\u00a0<\/span><span data-contrast=\"none\">could<\/span><span data-contrast=\"none\">\u00a0get around the extra surcharge on second homes.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;134233279&quot;:true}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Since the\u00a0<\/span><span data-contrast=\"none\">additional<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">3% tax was introduced in April 2016, the<\/span><span data-contrast=\"none\">\u00a0government has taken nearly\u00a0<\/span><span data-contrast=\"none\">\u00a34.9bn through the second-home tax and has refunded \u00a3618m.<\/span><span data-contrast=\"none\">\u00a0Some 45% of HMRC\u2019s\u00a0<\/span><a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/05\/30\/could-you-have-overpaid-on-your-stamp-duty-bill\/\"><span data-contrast=\"none\">stamp duty<\/span><\/a><span data-contrast=\"none\">\u00a0income is from\u00a0<\/span><a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2017\/11\/15\/surprising-numbers-brits-planning-to-buy-second-homes\/\"><span data-contrast=\"none\">second homes<\/span><\/a><span data-contrast=\"none\">.
