{"id":14347,"date":"2018-04-03T12:15:13","date_gmt":"2018-04-03T11:15:13","guid":{"rendered":"https:\/\/www.buyassociation.co.uk\/?p=14347"},"modified":"2023-10-09T14:41:32","modified_gmt":"2023-10-09T13:41:32","slug":"right-to-rent-causing-more-landlords-to-fear-letting-to-foreign-tenants","status":"publish","type":"post","link":"https:\/\/www.buyassociationgroup.com\/en-gb\/news\/right-to-rent-causing-more-landlords-to-fear-letting-to-foreign-tenants\/","title":{"rendered":"&#8216;Right to rent&#8217; causing landlords to avoid letting to foreign tenants"},"content":{"rendered":"<p><strong>The Residential Landlords Association (RLA) is calling for a judicial review of the government&#8217;s &#8220;right to rent&#8221; policy after it emerged that landlords are being put off letting to non-UK nationals due to fear of sanctions.<\/strong><\/p>\n<p>All landlords in the UK must check that their tenants have the right to rent in the UK before agreeing their tenancies, regardless of the tenant&#8217;s nationality, and <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/03\/21\/tenant-and-landlord-money-will-soon-be-protected-by-new-scheme\/\">landlords<\/a> who fail to carry out the relevant checks, or let out properties knowing their tenants are not legally eligible, face penalty fines.<br \/>\n[crb_image link=&#8221;https:\/\/www.buyassociationgroup.com\/en-gb\/advice\/property-investment-starter-course\/&#8221; image=&#8221;https:\/\/cdn2.hubspot.net\/hubfs\/1717782\/Asset_Store\/WebCTA\/cta.jpg&#8221; align=&#8221;left&#8221;]<br \/>\nHowever, research from the Joint Council for the Welfare of Immigrants has found that more than half (51%) of landlords have been deterred from letting to <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/03\/28\/the-true-effects-of-foreign-investment-in-uk-property-market\/\">foreign nationals<\/a> as a result of the scheme, with 48% stating they were less likely to rent to someone who didn&#8217;t have a British passport for fear that they could be at risk of sanctions. A further 49% said they were less likely, because of &#8220;right to rent&#8221;, to let property to someone who only had permission to live in the UK for a limited amount of time.<\/p>\n<p>With 17% of UK residents currently not in possession of a passport, these figures have been flagged up by the RLA, and the association has called for a suspension of the &#8220;right to rent&#8221; policy until a full evaluation of its impact has been carried out.<\/p>\n<h4>Controversial and unwelcome policy must be reviewed<\/h4>\n<p>A report by David Bolt, independent chief inspector of <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/04\/30\/windrush-generation-new-right-to-rent-rules-issued-by-government\/\">Borders and Immigration<\/a>, was published last week attacking the scheme, with Bolt arguing that the policy has &#8220;yet to demonstrate its worth as a tool to encourage immigration compliance&#8221;\u00a0and that the Home Office is &#8220;failing to coordinate, maximise or even measure effectively its use, while at the same time doing little to address the concerns of stakeholders&#8221;.<\/p>\n<p>Commenting on the inspector&#8217;s report, RLA policy director David Smith said:<\/p>\n<blockquote><p>&#8220;[The] report is a damning critique of a failing policy.\u00a0Landlords should not be used as scapegoats for the failures of the border agencies. It is time to suspend this controversial and unwelcome policy.&#8221;<\/p><\/blockquote>\n<p>Chai Patel, legal policy director at the Joint Council for the Welfare of Immigrants, added: &#8220;It\u2019s disgraceful that the Home Office has refused to properly evaluate whether or not the right to rent scheme is actually working to reduce irregular migration. They have no idea.&#8221;<\/p>\n<p>Discrimination in the <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/03\/16\/what-average-rent-uk-where-rising-most\/\">private rented sector<\/a> has been highlighted recently after a female tenant <a href=\"https:\/\/www.buyassociationgroup.com\/en-gb\/2018\/02\/27\/landlords-soon-forced-accept-dss-tenants-new-ruling\/\">won a case<\/a> against a letting agent who refused to accept her due to her benefits status, which has prompted calls for a review of landlords and agents who ban &#8220;DSS&#8221; tenants from applying.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Residential Landlords Association (RLA) is calling for a judicial review of the government&#8217;s &#8220;right to rent&#8221; policy after it emerged that landlords are being put off letting to non-UK nationals due to fear of sanctions.
